Terms & Conditions
All quotations, contracts of sale and installations made by Quayside Fireplaces Limited shall be deemed to incorporate the following terms and conditions. No other agreement, reservation, promise, undertaking or understanding of any kind either verbal or otherwise shall form part of or alter, vary, supersede or operate as a waiver to the stated terms of business unless expressly made or accepted by Quayside Fireplaces Directors in writing.
These terms and conditions shall form a contract between us (Quayside Fireplaces Limited) acting as the supplier and you (The Client) acting as the recipient.
The contract is valid when you (the client/s) have paid your deposit to us.
1) Contract of Sale
a) The product(s) you (The Client) have chosen will be individually ordered/designed and will be made/ordered for you (The Client) exclusively. The product(s) will be customised to suit you (The Clients) particular requirements. The product(s) will be made and supplied by us, on a design and supply basis only, unless otherwise stated in writing.
b) As with all natural materials such as real timber, marble, slate and granite, minor markings or unusual grain patterns may be present. These are not defects but part of the natural character of the piece.
c) The costing and arrangements for installation is a strict transaction between us (Quayside Fireplaces) and you (The Client) unless otherwise stated in a written contract involving any other firm or individuals.
d) Quayside Fireplaces Limited may introduce or recommend a company or individual. You (The Client) are completely free to obtain quotations for work from any other third party source, individual or companies, at your discretion. All work arrangements and actions carried out by a third party will be solely their responsibility and under no circumstances will quayside fireplaces limited be made responsible for any work undertaken or damage caused by them.
e) Payment for all materials and/or installation is stated as 50% of the total amount payable prior to the ordering of any goods, a further 30% is to be paid to us no later than 7 days before the agreed installation date. The remaining 20% of the total balance is to be paid no later than 7 days of the completed installation, unless otherwise stated. Quayside Fireplaces reserve the right to reserve full payment in advance at their sole discretion. Failure to ensure the remaining balance is paid within 7 days of the installation being completed will result in additional charges being added which is 2% of the total amount payable per day until the remaining balance is settled.
f) Ordering of goods and/or other works will not be undertaken until deposit is received for 50% of total amount payable plus another 30% no later than 7 days before the installation, please note if you are paying via cheque works/goods will be on hold until the funds have cleared.
g) Deposits will be refundable, should you (The Client) decide that you do not wish to proceed with the sale *ONLY IF GOODS HAVE NOT BEEN ORDERED*. If goods (or part of) have been ordered / delivered the client will bear the restocking charge of 20% of the total individual item value being returned and any delivery charges, courier charges and any other related charges that are incurred due to the item being returned to the supplier. There will also be an admin Fee of £120+vat that will also be deducted from your deposit to cover our admin costs and time should you wish to cancel your order/s. The items that will be subject to the restocking charge will be solely at our discretion.
h) All items manufactured by others and supplied to Quayside fireplaces limited and then passed or sold to the client will be covered by the relevant manufacture’s general guarantee (slate, marble and granite, being natural products, do not carry any form of guarantee for natural occurrences).
i) It is your (The Clients) sole responsibly to ensure that all required work is conducted prior to installation of the new fireplace/appliance.
j) It is your (The Clients) sole responsibly to ensure that chimneys are swept and inspected prior to installation of any appliance by a competent person/persons
a) We (Quayside Fireplaces) reserve the right to change fitting dates to accommodate situations out of our control. We will not under any circumstances cover for any loss of time/wages etc if we have to move any installations.
b) You (The Client) will ensure reasonable access to the property to ensure installation within a mutually agreed time period. Please note if you need to vacate the property for any reason throughout the installation our fitters cannot be expected to vacate as this will delay the installation and can lead into further time required in order to complete the installation, we would of course then charge for the additional time.
c) You (The Client) should take all reasonable steps to ensure the safety, security of any furnishings, carpets, sofas etc. against any disruption caused by the installation. We (Quayside Fireplaces Limited) will not be held responsible for any damage to your (The Client’s) property that is not secured and made safe from any works conducted.
d) We (Quayside Fireplaces) will not be held responsible for any decoration being disturbed, marked or damaged during the installation or works carried out.
e) We (Quayside Fireplaces) will not be held responsible for any third party or accept, any claims arising from damage, accidental or otherwise, after the completion of work and inspection of all parts installed.
f) We (Quayside Fireplaces Limited) will not under any circumstances remove waste that has resulted from any third parties working at the premises or that have not resulted from works undertaken by Quayside Fireplaces.
g) We will not be held responsible for fitting any carpets/flooring before or after the installation of the fireplace or works undertaken.
h) Skirting boards should be removed prior to our installation and refitted by a competent tradesman after the installation is complete. We DO NOT replace them and will not be responsible for any damages to skirting upon removing them to carry out the installation.
i) In the event of any unforeseen problems either structural and/or other on the removal of any existing fireplace, opening of a chamber or other instructed works, we (Quayside Fireplaces Limited) reserve the right to quote for any addition works required to complete the original installation of products. You (The Client) are completely free to obtain quotations for this work from any other third party source, individual or companies, at your discretion. All work arrangements and actions carried out by the third party will be solely their responsibility and under no circumstances will we (Quayside Fireplaces limited) be responsible for any work undertaken or damage caused by them.
j) In the case of unforeseen problems, you (The Client) remain wholly responsible for full payment of the outstanding balance on installation of the goods as stated in section (3a) irrespective of any other work undertaken by third parties.
K) In the case of an unforeseen problem that arises during the installation that prevents the installation being completed you (the client) would be liable to 50% of any incurred costs ie labour costs, restocking charges for any materials, delivery charges etc.
L) It is required that the fitters have access to welfare facilities throughout the duration of the installation.
M) we require a 240v power supply in order to carry out our installations, if there is no power available please contact use well in advance as we may need to re arrange the installation.
3) Post Installation
a) Payment must be made in full on the final day of completion of our work. Or unless agreed otherwise in writing by the company director/s
b) Quayside Fireplace will charge £55 for every cheque returned by the bank for insufficient funds.
c) If any legal action is brought by us (Quayside Fireplaces Limited) to collect monies, you (The Client) will be liable to pay the full outstanding balance plus interest, at the rate of two per cent (5%) above base per month plus any expenses incurred during collection of monies owed.
d) It is solely your (The Client’s) responsibility to insure the appliance installed receives regular maintenance.
e) Quayside Fireplaces Limited hereby guarantee our workmanship for 12 months from the date of completion of any installations we carry out. If any issues or problems arise with our workmanship after this date one of our qualified engineers will inspect and report to us (quayside fireplaces) so we could then discuss the best way to move forward and the costs involved.
f) we guarantee all twin wall flue flashings for a period of 12 months from the date of installation. If the silicone sealant fails after this period we are happy to return and re seal but this would be an additional cost. We would recommend the flashing to be checked annually for leaks.
